1. Agreement to Terms
By accessing and using DarkRoom Quest services, booking our horror quest rooms, or visiting our facility located at 13 Shadow Ln, Hobart TAS 7000, Australia, you agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between you and DarkRoom Quest Pty Ltd. If you do not agree with any part of these terms, you must not use our services or enter our premises.
We reserve the right to modify these terms at any time without prior notice. Your continued use of our services after any changes indicates your acceptance of the modified terms. It is your responsibility to review these terms periodically for updates.
2. Age Requirements and Restrictions
2.1 Minimum Age
All participants must be at least 16 years of age to enter any DarkRoom Quest experience. Participants aged 16-17 must provide written parental or legal guardian consent before participation. We strictly enforce age verification and reserve the right to request valid photo identification.
2.2 Parental Consent
For participants under 18 years of age, a parent or legal guardian must sign a consent form acknowledging the intense nature of our horror experiences. This consent form must be completed prior to entry and cannot be waived under any circumstances.
Important Health and Safety Notice
Our horror quest experiences involve complete darkness, sudden scares, loud noises, intense psychological content, confined spaces, and simulated horror scenarios. These experiences are NOT recommended for individuals with heart conditions, respiratory problems, epilepsy, pregnancy, severe anxiety, claustrophobia, or any other serious medical conditions.
3. Health and Safety Requirements
3.1 Medical Conditions
Participants must disclose any relevant medical conditions before participating. DarkRoom Quest experiences are not suitable for individuals with:
- Heart conditions, cardiovascular disease, or pacemakers
- Epilepsy, seizure disorders, or sensitivity to strobe lights
- Respiratory conditions including asthma, COPD, or breathing difficulties
- Pregnancy at any stage
- Severe anxiety disorders, PTSD, or panic disorders
- Claustrophobia or fear of confined spaces
- Recent surgery or physical injuries
- Any condition that could be aggravated by stress, darkness, or sudden movements
3.2 Physical Requirements
Participants must be able to navigate in complete darkness, move through confined spaces, climb stairs, and maintain physical balance without assistance. Some experiences may require crawling, ducking, or navigating uneven surfaces.
3.3 Intoxication Policy
Participants under the influence of alcohol, drugs, or any impairing substances will be refused entry without refund. We reserve the right to administer sobriety tests and deny entry to anyone appearing intoxicated or impaired.
4. Booking and Payment Terms
4.1 Reservations
All bookings must be made in advance through our official website, phone, or email. Walk-in availability is limited and not guaranteed. Confirmation emails must be presented upon arrival either printed or on a mobile device.
4.2 Payment
Full payment is required at the time of booking. We accept major credit cards, debit cards, and electronic payment methods. Group bookings of 8 or more participants may arrange payment plans by contacting our office directly.
4.3 Cancellation Policy
- More than 7 days before: Full refund minus 10% processing fee
- 3-7 days before: 50% refund
- Less than 3 days: No refund, but rebooking within 60 days permitted
- No-shows: No refund or rebooking allowed
4.4 Rescheduling
Bookings may be rescheduled up to 48 hours before the scheduled time without penalty. Rescheduling requests made less than 48 hours before will incur a $50 administrative fee per booking.
5. Participant Conduct and Rules
5.1 Expected Behavior
Participants must treat staff, actors, and other guests with respect at all times. Aggressive behavior, inappropriate touching, verbal abuse, or harassment of any kind will result in immediate removal without refund and potential legal action.
5.2 Prohibited Items
The following items are strictly prohibited inside quest rooms:
- Mobile phones, cameras, or recording devices
- Weapons of any kind (real or replica)
- Lighters, matches, or open flames
- Food and beverages
- Large bags or backpacks
- Loose jewelry or accessories that could catch on props
Secure lockers are provided free of charge for storing personal belongings.
5.3 Property Damage
Participants are financially responsible for any intentional or negligent damage to props, equipment, or facilities. Costs for repairs or replacement will be billed to the responsible party. Accidental damage during normal participation is not penalized.
5.4 Photography and Recording
Photography, video recording, and audio recording inside quest rooms are strictly prohibited to maintain immersion and protect proprietary content. Violation will result in immediate termination of the experience without refund.
6. Liability and Assumption of Risk
6.1 Voluntary Participation
Participation in DarkRoom Quest experiences is entirely voluntary. By participating, you acknowledge that you understand the intense nature of our horror experiences and voluntarily assume all risks associated with participation.
6.2 Waiver of Liability
To the fullest extent permitted by law, DarkRoom Quest, its owners, operators, employees, and agents shall not be liable for any injuries, accidents, illness, death, or property damage arising from your participation in our experiences, except in cases of gross negligence or willful misconduct on our part.
6.3 Medical Emergency
In the event of a medical emergency, you authorize DarkRoom Quest staff to provide or arrange for emergency medical treatment. You are responsible for all costs associated with such treatment, including ambulance services and hospital care.
6.4 Insurance
We strongly recommend participants maintain adequate health and personal injury insurance. DarkRoom Quest does not provide insurance coverage for participants.
7. Right to Refuse Service
DarkRoom Quest reserves the unconditional right to refuse service or entry to any person for any reason, including but not limited to:
- Failure to meet age or health requirements
- Appearing intoxicated or under the influence of substances
- Aggressive, disruptive, or inappropriate behavior
- Failure to follow safety instructions or staff directions
- Previous violations of our terms or facility rules
- Possession of prohibited items
Refused entry or removal from the premises does not entitle participants to any refund.
8. Intellectual Property Rights
All content, designs, concepts, storylines, puzzles, technology, audio, visual elements, and other intellectual property used in DarkRoom Quest experiences are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works based on any aspect of our experiences without explicit written permission.
The DarkRoom Quest name, logo, and all related trademarks are the exclusive property of DarkRoom Quest Pty Ltd and may not be used without authorization.
9. Privacy and Data Protection
We collect and process personal information in accordance with our Privacy Policy. By using our services, you consent to such collection and processing. We use biometric monitoring equipment solely for safety purposes during experiences, and this data is not stored beyond the duration of your session.
For group events and corporate bookings, summary performance data may be provided to the booking contact, but individual participant data remains confidential.
10. Force Majeure
DarkRoom Quest shall not be liable for failure to perform obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, power outages, equipment failures, government actions, pandemics, strikes, or other unforeseen events. In such cases, we will attempt to reschedule your experience or provide a full refund.
11. Severability
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
12. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of Tasmania, Australia. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Tasmania.
